(UPDATE) NPA men abduct Surigao town mayor, 2 security aides

MANILA, Philippines - Suspected New People's Army (NPA) members kidnapped the town mayor of Lingig in Sugirao del Sur and his two military escorts this morning.

Chief Superintendent Reynaldo Rafal, Caraga regional police director, said that at least 30 rebels took Mayor Henry Dano from his residence in Barangay Lingig Poblacion around 6:30 a.m.

Rafal said that based on initial investigations, the rebels gained entry into the gated residence of the mayor after one of them, wearing a Barong Tagalog, introduced himself as an agent of the National Bureau of Investigation (NBI).

He said that the other rebels, on board three vehicles, were wearing camouflage uniforms.

The rebel disguised as an NBI agent was able to convince a household helper of the mayor to open the gate. As soon as the gate was opened, the rebels disarmed the mayor's security aides.

In a matter of minutes, the rebels escaped with the mayor and his two military security aides.

Initial information obtained by the police showed that the rebels drove their vehicles to Boston town in Davao Oriental.

The regional police and military units have launched search and rescue operation for the mayor and the two other victims.

On June 20, 1988, around 11:30 pm in Basco, Batanes, Acaya arrived in a baptismal party. As he was drunk, he flaunted that he is one of Honasan’s men and a member of the Philippine Constabulary – Integrated National Police. He then fired shots in the air scaring everybody. He went to a certain Rodriguez and shot him in the face causing his death. He continued his frenzy, fortunately nobody else died due ti the intervention of a certain Viola. Acaya was convicted for murder.

ISSUE: Whether or not the aggravating circumstance of taking advantage of one’s public position is attendant?

HELD: Treachery was not proven so Acaya should only be charged for homicide. It is established that taking advantage of one’s public position is attendant for Acaya used his service armalite in shooting Rodriguez and he even boasted his being a PC. The alternative circumstance of drunkenness should be appreciated in Acaya’s favor as his drinking was only incidental.
